Agency Agreement Execution Procedures

The agreement is to be made out in 3 (three) sets – as per the agreed terms and conditions. The agreement is to be forwarded to us in triplicate for signature. Following signature, we will return all three sets for your necessary action.

Duties on your end:

-The agreement is to be signed by your appropriate authority.
-You are to retain one copy for your records.
-Attest 2 (two) sets by your local Arab Chamber of Commerce.
-Have them legalized by the Kuwaiti Embassy in your country.
-Return 2 (two) legalized copies to us.

Duties on our end:

-We will take care of translation procedure.
-Have them attested by the ‘Ministry of Foreign Affairs’.
-Have them attested by the ‘Ministry of Justice’.
-We will have them registered at the ‘Ministry of Commerce & Industry’.
-Proceed with procedures for approved vendor listing with local customers.

Achieving status of ‘Approved Vendor Listing’ is a tedious process that may take up to 6 months to establish. We urge new companies represented by us to speedily fill the applications provided to them and have them returned swiftly to allow for a faster approval. VEC (Vendor Evaluation Committee) and CEC (Contractor Evaluation Committee) forms are separate and each incorporate specific guidelines that must be adhered to in order for them to be accepted. Principals must be aware of the fact that regardless of status or prestige, they will not be invited to bid unless approved by the relevant committee.

The agency agreement must have a definite duration or life and not be perpetually renewing until either party request a cancellation. This is due to a ‘Ministry of Commerce & Industry’ stipulation. Any company name change or product variation may be subject to a resubmission to both the VEC and CEC (or which ever is relevant). Certain local customers must approve each and every manufacturing facility. Approval of a single facility does not mean approval for the remaining facilities a company may have.
